These terms govern the GrayDarth store, custom commissions, memberships and collaborations. By purchasing, commissioning or subscribing, you accept them.

01Who operates this site

02What these terms cover

• Digital products — 4K live wallpapers and other digital downloads, sold through the GrayDarth store (checkout operated by Gumroad) and, for some releases, through Stripe payment links or other platforms (Etsy for physical posters, Wallpaper Engine on Steam).
• Custom commissions — bespoke live wallpapers, motion posters and cinematic animations, created on request under an individual quote or proposal.
• Memberships — recurring supporter tiers hosted on Patreon and similar platforms, governed additionally by those platforms' own terms.
• Brand collaborations — commercial partnerships, governed by their own signed proposal or agreement, which prevails over these terms in case of conflict.

Some links on this site are affiliate links (e.g. Amazon, Sideshow, Instant Gaming). I may earn a commission on qualifying purchases at no extra cost to you.

03Digital products & store

Purchases made on the store are processed by third-party checkouts (Gumroad, Stripe, PayPal). Your purchase is also subject to the processor's own terms and privacy policy.

Each digital product is delivered as a download and comes with a personal-use license: you may use the files on your own devices and screens. You may not resell, redistribute, share, sublicense, publicly re-upload, mint as NFT, or claim authorship of the files, whether modified or not, and whether free or paid.

Prices are shown at checkout in USD or EUR; your bank may apply conversion fees. As a French micro-enterprise, sales are invoiced without VAT (art. 293 B CGI).

04Custom commissions

Each commission is defined by an individual quote or proposal (scope, deliverables, revisions, timeline, license, price). That document, once accepted, forms the contract together with these terms.

• Acceptance. A commission is confirmed by signature of the proposal and/or by payment of the deposit stated in it. Paying the deposit constitutes express acceptance of the proposal, of these terms, and — for consumers — an express request to begin work before the end of any withdrawal period.
• Deposit & balance. Unless the proposal states otherwise, work starts once the deposit is received; the balance is due before delivery of final files. The deposit is non-refundable once production has started. If a project is cancelled mid-production, completed work remains payable.
• Previews. Review versions are watermarked. Final, clean files are delivered upon full payment.
• Client artwork. When you supply artwork to be animated, you confirm you hold the rights (or permission) required for that use. You remain responsible for the source artwork; I remain the author of the animation work.
• Revisions. Rounds included are stated in the proposal; additional rounds are billed separately. Feedback delays extend the timeline accordingly.

05Payments & invoicing

Payments are accepted by card or wallet via Stripe payment links, via Gumroad checkout, or via PayPal, as indicated at the time of purchase. For commissions and business clients, a compliant French invoice is issued for each payment (deposit and balance).

For business clients: late payments incur interest and the statutory €40 recovery indemnity (art. L441-10 and D441-5 of the French Commercial Code).

06Refunds & EU right of withdrawal

If you are a consumer in the EU, you normally have a 14-day right of withdrawal on distance purchases. Under article L221-28 of the French Consumer Code, this right does not apply to:

• digital content supplied immediately and not on a tangible medium, once you have expressly consented to immediate delivery and acknowledged losing your withdrawal right (this consent is collected at checkout for downloads);
• goods and content made to your specifications or clearly personalised — which covers custom commissions;
• services fully performed before the end of the withdrawal period with your prior express agreement.

Accordingly, sales of delivered digital files and commissioned work are final, except where the law provides otherwise or where a product is materially defective. If something is wrong with your order (corrupted file, wrong export, missing deliverable), write to support@graydarth.com — I will always fix a legitimate problem.

07Intellectual property

All original artworks, animations, motion work, videos, text and branding on this site and its stores are the property of Pierre Lacaille (GrayDarth) and are protected by copyright. Purchasing a product or commission grants you the license described in section 03 or in your proposal — it does not transfer copyright unless a written buyout says so.

You may not use any GrayDarth content, free or paid, to train, fine-tune or feed AI / machine-learning models, nor for automated scraping or dataset building.

Fan-inspired content. Some pieces are unofficial tributes inspired by existing universes (e.g. Star Wars, Arcane, Dune, Avatar). All rights to those universes belong to their respective owners (Lucasfilm Ltd., The Walt Disney Company, Riot Games, and others). GrayDarth is not affiliated with, sponsored by, or endorsed by these rights holders. Fan-inspired pieces are provided for personal, non-commercial enjoyment only. Original creations are entirely my own.

08Acceptable use

You agree not to misuse this site or its content: no unauthorised redistribution or resale, no re-uploading files to third-party platforms, no removal of watermarks or credits, no use of the content in unlawful, hateful or misleading contexts, and no attempt to disrupt the site or its checkout services.

09Liability

The site and its content are provided "as is". To the extent permitted by law, I am not liable for indirect damages (loss of profits, data or opportunity) arising from the use of the site or products, and my total liability for any claim is limited to the amount you actually paid for the product or service concerned. Nothing in these terms limits liability that cannot be limited under applicable law, nor consumers' statutory guarantees (including the legal guarantee of conformity for digital content, art. L224-25-12 s. French Consumer Code).

10Privacy & data

Orders require basic data (name, email, billing address), processed by GrayDarth and its payment processors (Stripe, Gumroad, PayPal) to deliver your purchase, issue invoices and meet legal obligations. Data is kept only as long as required (accounting documents: 10 years). Under the GDPR you may access, correct, delete or port your data, and lodge a complaint with the CNIL. 11Disputes, mediation & law

If there is a problem, contact me first at contact@graydarth.com — most issues are solved within days.

In accordance with articles L611-1 s. and L612-1 of the French Consumer Code, consumers may use free consumer mediation. Designated mediator: [MEDIATOR_NAME_AND_WEBSITE]. EU consumers may also use the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

These terms are governed by French law. For business clients, the courts of Rennes (France) have exclusive jurisdiction. Consumers keep the benefit of any mandatory protective rules and forums of their country of residence.

12Changes to these terms

These terms may be updated as the services evolve; the date above reflects the latest version. The version in force at the time of your purchase applies to that purchase.
